What is the ODR platform?
The European Online Dispute Resolution (ODR) platform is provided by the European Commission to make online shopping safer and fairer through access to quality dispute resolution tools.
If you are in the EU, Norway, Iceland or Liechtenstein you can use it to find the best solution for your consumer problem, to discuss a solution directly with a trader concerning your problem or to agree on a dispute resolution body to handle your case.
The ODR platform is not connected to any trader. You can use the ODR platform in all EU languages, Icelandic and Norwegian.
- This obligation to inform the mioux.eu customers stems from the EU Regulation No 524/2013 on online dispute resolution in consumer matters, which has been incorporated into Romanian law and became effective from 9 January 2016.
- According to the Regulation, those who enter into online sale-purchase contracts or online service contracts (i.e. all professionals operating online businesses/firms/sites) must provide their customers with the link to this alternative dispute resolution.
- Online dispute resolution or ODR for short is a method of out-of-court settlement of complaints relating to purchases made on the Internet.
- It is an initiative of the European Commission, and is intended to ease the burden on the courts (such as the costs and efforts of legal proceedings – often excessive for someone who has bought just a few products on the Internet).
- It has the advantage of lower costs and is dealt with more quickly than court proceedings.
- The methods of online settlement are: “mediation”, “conciliation”, “arbitration”, “ombudsman” or “appeal chamber”.
- When an alternative dispute resolution is used, the plaintiff requests the intervention of a neutral party to act as an intermediary between him and the trader.
- The solution offered by the intermediary is sometimes optional (it takes the form of a suggestion), and sometimes mandatory for either or both parties. At other times, the intermediary only brings the parties together to discuss possible solutions.
