Terms and conditions

Before purchasing a product from the online shop, please read carefully the Terms and Conditions section.

 

1. DEFINITIONS

Mijoux – commercial name of GCONF COMERCIAL SRL, with the identification and contact details provided in Art. 2 of this document.

Website – domain www.mijoux.eu.

Visitor – any natural person or legal entity accessing the Site.

User – any natural person or legal entity registered on the Site by creating an Account.

Customer – the User or, as the case may be, the Visitor who places an Order on the Site

Order – the electronic document by means of which the Customer transmits to Mijoux his/her intention to purchase products from the Site.

Account – the section of the Site consisting of an e-mail address and a password that allows the Customer to submit the Order and which contains information such as username, password, delivery address and order history.

Shopping Cart – section of the Site where the User can add products he/she wishes to purchase.

Withdrawal period – The period of 14 calendar days during which the Customer has the right to withdraw from the contract, in accordance with the provisions of Emergency Ordinance No. 34/2014. The withdrawal period shall expire within 14 calendar days from the day on which the Customer or a third party other than the carrier and which is indicated by the Customer takes physical possession of the products or, if the Customer orders in a single order multiple products to be delivered separately, the day on which the Customer or a third party other than the carrier and which is indicated by the Customer takes physical possession of the last product.

 

2. COMPANY

(1) GCONF COMERCIAL SRL is registered with the Trade Register under number J40/94/2007, with Unique Registration Code: RO 20362137, IBAN account RO07BTRLRONCRT0247030401 opened at Banca Transilvania, Unirii Branch, Bucharest and with registered office at Mitropolit Veniamin Costache Street, No. 13, Sector 5, Bucharest, telephone/fax number 0314210006, e-mail address office@gconf.ro .

(2) GCONF COMERCIAL SRL is registered with ANPC for operations with precious metals and stones, Authorization no. 0011319/20.08.2020.

 

3. GENERAL INFORMATION

(1) The images published on the Site are true to reality, but sometimes the shades of the colors of the products may differ slightly due to the process of taking the photos or the settings of the user’s monitor.

(2) The Customer will always be informed about the availability of a product in stock, whether the product can be customized at the Customer’s request, as well as the processing and delivery time. e.

(2) The information in para. (2) will be sent to the Customer by e-mail, message or telephone. Products sold through Mijoux shall be accompanied by the tax invoice or tax receipt and guarantee certificate.

 

4. COPYRIGHT

(1) The entire content of the Site is protected under copyright law and the law on intellectual property rights.

(2) The use of any elements belonging to the Site without the written consent of Mijoux shall give rise, as the case may be, to criminal, civil or civil liability.

(3) The Customer agrees not to affect or interfere in any way with the security features of the Site, features that prevent or restrict the use, copying of content or features that reinforce the limits of use of the Site or its content.

 

5. CONFIDENTIALITY AND PROTECTION OF PERSONAL DATA

(1) Mijoux has a strict policy of respecting the confidentiality of Customer data.

(2) By accessing the Site, Mijoux processes personal data necessary to fulfill the purposes for which such data was requested and stored. With regard to the rights of Data Subjects, as guaranteed by Regulation 2016/679/EU on the protection of personal data and on the free movement of such data, please see the Privacy Policy provided and the other measures implemented to guarantee your rights.

(3) The transmission by the Client, via the Site, of information or materials, ideas, concepts, know-how, techniques, etc. gives Mijoux unrestricted access to them, the right to use, reproduce, display, modify, transmit and distribute these materials or information.

 

6. PRODUCT INFORMATION AND PRICES

(1) The prices displayed on the Site are in EUR, including Romanian VAT. The prices displayed are valid at the time of accessing the page where they are displayed.

(2) Mijoux reserves the right to change the price of the products at any time, without prior notice or notification, including in the event of fluctuations in the BNR exchange rate of the gold gram (XAU). Product availability and delivery time will be communicated by e-mail by Mijoux representatives after placing the Order.

(3) By placing an Order on the Site, the Customer undertakes to pay the consideration for the products ordered. In this respect, Mijoux, within the framework of the Order registration procedure, reserves the right to redirect Customers to the websites of electronic payment processors in order to collect the data required for payment.

(4) Despite our best efforts, certain products may be displayed on the Site with incorrect prices, for a short period of time necessary for the Site to update. Wrong prices are those prices well below the market level for similar gold jewellery. Example of a wrong price: 14k yellow gold pendant necklace at 30 EUR instead of 300 EUR. In this situation, Mijoux will not honor orders with wrong prices and will refund the Customer any amounts paid in advance.

 

7. USER REGISTRATION

(1) The Visitor may register on the Site by accessing the “New Account” section available on the main page of the Site and completing the appropriate steps required for registration.

(2) Registration requires the following data: name, surname, e-mail address and password. The User is obliged to enter a valid e-mail address, otherwise it will not be possible to continue the registration procedure on the Site. The User is fully responsible for the safekeeping of the access password as well as any registration, login and Account information. The User is fully responsible for any order and/or payment made using the Site from his/her Account.

 

8. ORDER PLACEMENT AND CONFIRMATION

(1) Placing the Order is done by completing the following steps:

The Customer selects the desired products and adds them to the Shopping Cart by clicking on the “Add to Cart” button. To add more products to the Cart, the “Continue Shopping” button can be accessed. After adding the products to the Cart, the Customer enters the Account. If he does not have and does not want to make an account, he can access the button “Checkout as Visitor” – where he enters a valid e-mail address to confirm receipt of the Order.
The customer enters their details: delivery address, billing details, choose a payment method.
The customer ticks the field “I agree with the Terms and Conditions on the website”, after carefully reading them.
The customer has the possibility to agree to receive Newsletters.
The customer places the order by clicking on the “Complete Order” button.

(3) By clicking on the “Complete Order” button, the Customer is obliged to pay for the products and, if applicable, the shipping costs.

(4) Adding products to the Shopping Cart without clicking on the “Complete Order” button does not constitute a reservation of the products or registration of the order.

(5) By filling in the order form and completing the payment, the Customer assumes the responsibility that all data provided is correct and complete at the time of purchase.

(6) Order confirmation is carried out by sending an e-mail to the e-mail address indicated by the Customer when placing the order.

 

9. PAYMENTS AND LIMITATIONS

(1) Mijoux aims to provide its customers with as detailed a description as possible of its products on the Site, but does not guarantee that the description of the products or any other information on the Site is complete or totally error-free. Furthermore, Mijoux shall not be liable for any losses such as loss of data, lost profits, inability to use the data on the Site, changes without prior notice to the data, prices or structure of the Site.

(2) The customer is obliged to choose the chosen payment method before completing the order, by ticking the appropriate option, according to the steps for placing the order detailed in point 8. .

(3) If the Customer has opted for online payment, in cases where the Customer’s card issuing bank does not accept payment or the data provided by the Customer is erroneous or incomplete, Mijoux reserves the right to cancel the Order. Mijoux will issue a notice to this effect to the Customer and will be released from any further obligation.

(3) Mijoux will issue the Customer with an invoice or a tax receipt for the delivered products, in accordance with the legislation in force. In this respect, the Customer is obliged to provide Mijoux with all the information required to issue the invoice or tax receipt. The invoice in physical format will be communicated to the Customer upon delivery of the ordered products.

(4) Mijoux reserves the right to require payment of a minimum deposit of 30% for orders exceeding the amount of 1,500 EUR.

10. DELIVERY POLICY

(1) Products are delivered directly to the Customer’s home or to the address specified by the Customer in the order form available on the Site.

(2) Transport is provided by DHL Europe courier company, our personal couriers, as well as by other partner companies.  However, after prior agreement with Mijoux, orders can also be picked up from the warehouse.

(3) The cost of transport for products worth more than 100 EUR delivered in EU is covered by Mijoux. Otherwise the transport is to be paid by the Customer and the cost of transport is 20 EUR. If the place of delivery indicated by the Customer is not on the courier’s transport list, the Customer will pay the additional fee for an additional km to the nearest place on the courier’s list. The amount of this fee will be communicated upon confirmation of the Order.

(4) If the Customer wishes to change or adjust a product, he shall bear the costs of the transport.

(5) Mijoux offers the possibility to deliver the products by courier to other countries outside the European Union.  In this case, the Buyer shall bear the full cost of transportation, which includes all taxes and costs related to international delivery, including, but not limited to, the price of transportation, customs duties, fees for authorizations, etc. The amount of the cost of delivery outside the territory of EU shall be communicated to the Buyer within a reasonable time after placing the Order. Furthermore, in case of delivery of the Products outside EU, Mijoux reserves the right to refuse the Order if the Customer does not pay in advance either: (i) the transport fee communicated by Mijoux or (ii) a part of the Order’s value of at least 50%.

(6) Shipment of the Order for products in stock will be made within a maximum of 48 hours from the transmission of the Order confirmation by Mijoux. For products delivered within European Union, the Order should reach the Customer within a maximum of 3 working days from the date of the Order confirmation. This term may be modified by circumstances beyond our control, without exceeding a term of 10 working days, calculated from the date of the Customer’s order, for products in stock. For products delivered outside Romania, the delivery time will be extended, depending on the delivery location of the Order.

(7) For products that are not in Mijoux stock, the delivery term will be communicated separately to the Customer after the Order has been placed or after the request for replacement of the product has been sent, according to art. 11 paragraph (10) and will not exceed 30 calendar days.

(8) The Order shall be dispatched in packaging that ensures transport security. Liability for any damage caused during the transport of the product, parcel or package sent by Mijoux shall lie with the carrier in accordance with the local legislation in force.

 

11. RETURN POLICY

(1) Prior to the expiration of the Withdrawal Period, the Customer shall notify Mijoux of its intention to withdraw from the contract by sending a written e-mail to contact@mijoux.ro specifying the following:

– the product(s) they wish to return, indicating the details of the Order (number, date of Order, copy of invoice);

– the request for a refund;

– optionally, the reason for the return

(2) In order to exercise the right of withdrawal, the Customer may send the return form available here to the e-mail address indicated above: (link).

(3) Mijoux will communicate to the Customer the confirmation of receipt of the withdrawal form.

(4) Mijoux shall refund all amounts it has received as payment to the account indicated by the Client no later than 14 calendar days from the date on which it received the Client’s withdrawal decision. Mijoux is not obliged to reimburse additional costs if the Customer has explicitly chosen a type of delivery other than the standard delivery offered by Mijoux.

(5) Mijoux may postpone the reimbursement of the amounts referred to in para. (4) until the date of receipt of the products or until receipt of proof from the Customer that he has sent the products to Mijoux, whichever is earlier.

(6) Mijoux reserves the right to deduct from the amounts reimbursed to the Customer the amount resulting from the reduction in value of the products as a result of their handling by the Customer, if such handling is other than that strictly necessary to determine the nature, characteristics and functionality of the products.

(7) The client has to return the products at the following address: Mitropolit Veniamin Costache, Nr. 13, Sector 5, Bucharest, P.O. Box 050191, in the same condition in which they were received, in appropriate packaging, preferably by parcel with acknowledgment of receipt, together with all accompanying documents, no later than 14 days from the date on which the customer communicated to Mijoux his decision to withdraw from the contract. The mere return of the products without communication of the decision to withdraw from the contract shall not entitle the Customer to a refund of the amounts referred to in paragraph 1. (4)

(9) In the event of exercising the right of withdrawal, the cost of the return transport, including any customs duties or any other taxes related to transport, in the case of Orders that have been delivered outside Romania, shall be borne by the Customer. Mijoux reserves the right to refuse the returned products with payment of the freight on delivery and to return the product to the Customer at the Customer’s expense.

(11) If, at the time of delivery, the Customer observes any damage to the packaging of the parcel, Mijoux recommends refusal of delivery, with mention of the observed aspects in the AWB provided by the courier. In this situation, the Customer has the right to request the replacement of the ordered product. Any subsequent referral of these issues will not be taken into account.

(12) Worn products, products showing signs of wear due to mishandling, dents, scratches or any visible damage, products without labels, security seals, original packaging and those not accompanied by an invoice or a tax receipt, as well as products that have been modified in any way at the request of the Customer (e.g. personalisation by engraving) will not be accepted for return.

(13) The Customer may request the replacement of a product within 14 days from the date of its delivery by sending an e-mail to contact@mijoux.ro with the following details: product code to be sent to the Customer, size, color, and dimension.

(14) Upon receipt of the confirmation of the replacement request sent by Mijoux, the Customer shall return the products under the conditions set out in para. (7). The Customer shall bear the costs of returning the product for which the replacement is requested, the cost of transporting the product for which the replacement is requested and the difference between the price actually paid for the product for which the replacement is requested and the price of the product for which the replacement is requested, displayed on the date of transmission of the replacement request.

(15) In the event of repeated and successive requests for returns or replacements from the same Customer, Mijoux reserves the right to refuse to accept returns from that Customer.

 

12. TRANSFER OF OWNERSHIP OF THE PRODUCTS

(1) Title to the Products shall be transferred to the Customer upon delivery, after payment to the Customer, at the location indicated in the Order. Delivery means the signature of receipt of the transport document provided by the courier or the signature of receipt on the invoice (in case of collection of the products from Mijoux’s physical locations).

 

13. GUARANTEES

(1) All products sold by Mijoux benefit from guarantee conditions in accordance with the legislation in force in Romania.

(2) The guarantee certificate issued by Mijoux certifies that the products meet the quality parameters and requirements in accordance with the legal norms in force.

(3) The consumer’s rights are not affected by the guarantee conditions set out in this Guarantee Certificate. With this certificate of guarantee we assure you that Mixoux jewellery is marked in accordance with its own guarantee mark and title mark, which is authorised by the National Authority for Consumer Protection – Precious Metals Directorate. This guarantee certificate certifies that the jewellery is made of gold.

(5) The gold may be yellow, white or pink.

(6) The guarantee does not cover damage to the jewellery caused by failure to observe the indications given in the certificate, accidents, negligence, improper use or other factors unrelated to defects in material or workmanship.

(7) In case of non-conformity, the Customer may benefit from repair/replacement of the aflected products within the warranty period, unless the measure is impossible or disproportionate.

(8) The Customer may report the lack of conformity by sending an e-mail with a picture of the product to contact@mijoux.ro, containing the request for repair or replacement of the product.

(9) In case of non-conformity, the repair/replacement of the product shall be carried out free of charge within 15 days from the date of notification by the Customer, if it is established that a defect in workmanship was the cause of such damage.

(10) The term “free of charge” referred to in paragraph 1 shall be replaced by “free of charge”. (9) means all costs necessary to bring the products into conformity, including postal charges, transport, handling, survey, dismantling, assembly, labour, materials used and packaging costs

 

14. CONTRACTUAL LIABILITY

(1) The Customer is responsible for checking the final version of the Terms and Conditions whenever using the Site.

(2) Acceptance of the Terms and Conditions is confirmed by ticking the appropriate checkbox on the Site and/or by submitting the Order and/or making an online payment.

(3) Mijoux shall not be liable for any damages of any kind that the Customer or any third party may suffer as a result of Mijoux’s performance of any of its obligations under the Customer’s Order, nor for any damages that may result from the use of the Products after delivery, much less for the loss of the Products.

(4) Mijoux cannot be held liable for any damage to the Visitor’s/User’s device or viruses that may infect the device accessing the Site (computer, mobile phone, etc.) as a result of the access, use by the Customer or User or browsing on the Site or downloading by the Customer or User of any content, information, material, data, text, images, video or audio from the Site.

 

15. MAJOR FORCE

(1) The Customer and Mijoux shall not be liable for the failure to perform on time and/or the improper performance – in whole or in part – of any of its obligations under these Terms and Conditions if the failure to perform or the improper performance of such obligation was caused by force majeure, as defined by law, for reasons beyond the control of the parties.

(2) The party invoking force majeure is obliged to notify the other party within 5 (five) days of the occurrence of the event and to take all possible measures to limit its consequences.

 

16. APPLICABLE LAW

(1) These Terms and Conditions are governed and interpreted in accordance with Romanian law. Any disagreement arising between Mijoux and the Client in relation to the relations arising from these Terms and Conditions shall be settled amicably, and in case of failure, shall be submitted to the competent courts of the Municipality of Bucharest.

 

17. PROCEDURE FOR RESOLVING COMPLAINTS

(1) Any dissatisfaction related to access, use, registration on the Site, placing an Order, issues related to the Order placed and other such issues, shall be communicated directly, either by telephone, at the telephone number +40722533259, between Monday-Friday from 9 a.m. to 6 p.m., or by e-mail at contact@mijoux.ro.

 

18. FINAL PROVISIONS

(1) Mijoux offers the right to access and use the Site subject to acceptance by Visitors and Users of these Terms and Conditions.

(2) Mijoux has the right to modify the Terms and Conditions at any time, without prior notice, by publishing the updated version on the Site, and the Customer is obliged to read the Terms and Conditions whenever he/she accesses the Site. The Visitor/Customer/User is obliged to comply strictly with the Terms and Conditions on the site and may not claim or defend himself/herself by claiming ignorance of the Terms and Conditions on the site valid at the time of accessing, using and/or placing an order on the site.

(3) Reviews are hosted free of charge by Mijoux on the Site. As a result, Mijoux cannot be held responsible for the content of reviews on the Site by Customers, Users or Visitors. Although in the moderation process Mijoux makes every effort to identify and remove content that may infringe the intellectual property or other rights of third parties, there is a possibility that certain content published by Customers, Users or Visitors may infringe their rights. (4) Mijoux reserves the right to delete reviews, ratings or any other comments left by users that contain vulgar, offensive language against another Visitor/Customer/User or information that instigates violence on the basis of a Visitor/Customer/User’s race or ethnic origin, religion, disability, gender, age, sexual orientation or political opinion.

(5) Mijoux encourages customers to email contact@mijoux.ro and provide us with feedback on how the delivery went and their experience with the products ordered.
